The Pennsylvania Game Commission (PGC) is under scrutiny from Republican House Game and Fisheries Committee Chairman David Maloney for alleged lack of transparency. In a letter addressed to Governor Josh Shapiro, the state Office of Administration, and the PGC, Maloney expressed concerns over the commission's handling of meetings and decision-making processes.
Maloney highlighted an incident on May 12, 2024, when the PGC posted notice for a "Special Meeting of the Board of Commissioners" scheduled for the following day. He noted that this barely met the required 24-hour notice as stipulated in Title 65. According to Maloney, "public notice for a meeting must be shared 'in a newspaper of general circulation,'" which he claims was not done.
He criticized the PGC for failing to provide opportunities for public comment or participation during their meetings. "Posting a special meeting online, without the public’s ability to participate in any manner, is not reflective of an open and transparent Commission," he stated.
Maloney also questioned the appointment process of Stephen Smith as Executive Director, noting that no other candidates were interviewed nor was public input sought. He emphasized that reforms are necessary within the commission.
In his previous communications on May 8, 2024, Maloney had urged compliance with open meeting laws outlined in Title 65 § 713. He attached resources like “Open Meetings | The Sunshine Act” to guide the PGC in adhering to these regulations.
The letter concludes with several questions directed at the PGC regarding their compliance with transparency laws and procedures followed after Bryan Burhans’ resignation as Executive Director. Maloney suggested improvements such as publicly posting job openings and conducting interviews before making appointments.
